Clayton County, Georgia Arrest Records

Clayton County arrest records are the official county-maintained documents that record arrests occurring within the county's jurisdiction. These records typically include the arrested individual's identifying details, the date and place of the arrest, the alleged offense, and the stated basis for the arrest. They are created as part of the standard booking procedure after an individual is taken into custody.

To promote public safety, accountability, and government transparency, arrest records in Georgia, including those held by Clayton County, are generally accessible under the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.). However, access to criminal history record information, of which an arrest record is a part, is regulated separately. Disclosure with the subject's consent is governed by O.C.G.A. § 35-3-34, while access without consent is limited and controlled under O.C.G.A. § 35-3-34 (d.2).

Are Arrest Records Public Information in Clayton, Georgia?

Yes. Under the Georgia Open Records Act, Clayton County arrest records are generally presumed public and may be inspected or copies obtained upon request by members of the public. This statute establishes a broad right of access to such records, subject to specific statutory limits.

Accordingly, records that have been sealed by court order, expunged, or otherwise designated confidential are excluded from public disclosure. These include juvenile arrest records and records protected by judicial directive. In addition, sensitive personal data, such as social security numbers and information whose release would violate privacy rights or endanger an individual, is withheld from public access.

Further restrictions apply under O.C.G.A. §35-3-37, which governs the dissemination of criminal history information maintained by state agencies. Under this provision, comprehensive criminal history records, which include Clayton arrest data, may be released only to authorized individuals or entities.

Clayton County Arrest Search

Local law enforcement agencies typically generate and maintain arrest records as independent documents. At the state and federal levels, arrest information is generally not provided as a distinct record but is instead obtained through criminal history records, which are primarily compilations of data from court proceedings and other justice system sources.

In Georgia, state law allows public access to criminal records for lawful purposes such as personal review, employment screening, housing applications, and professional licensing. Arrest information at the state and federal levels may be requested from the Georgia Bureau of Investigation and the Federal Bureau of Investigation, respectively.

The Georgia Bureau of Investigation, Crime Information Center (GCIC) supports criminal history requests through in-person inspections, which are available by appointment only. Appointments may be scheduled by calling (404) 244-2639 and selecting option 1. Requests may also be submitted by mail with sufficient identifying information to assist in locating the record. Correspondence should be sent to

Additionally, arrest information may appear in a Federal Bureau of Investigation (FBI) Identity History Summary, commonly known as a RAP sheet. Full records are released only to the individual named in the report, and access requires payment of the processing fee. Inquiries may be directed to the FBI by email at identity@fbi.gov or by phone at (304) 625-5590.

Clayton County Inmate Locator

Clayton does not maintain a centralized, online arrest records database or public arrest log through its law enforcement agencies, including the Sheriff’s office. However, the Sheriff’s office operates an inmate search tool on its official website that provides access to current county inmate records. This system functions as a public inquiry platform and lists individuals who are actively in custody; these inmate records include limited arrest-related information.

The public may access the Sheriff's inmate search application by conducting an inmate search using a person’s name or by reviewing listings for the past 48 hours, 14 days, or 31 days.

Arrest records themselves are maintained by the individual arresting agencies. For mail or in-person requests, interested parties must contact the appropriate arresting agency directly and comply with its request requirements. Public inspection of arrest records is available at these agencies, including the Sheriff’s offices, where searches may be performed using a name, booking number, or a specified date.

Active Warrant Search in Clayton County

An arrest warrant in Clayton is a court-issued order authorizing law enforcement to take a named individual into custody. A warrant remains in effect until it is served, meaning the person listed has been arrested or appeared before a judge.

The issuance and service of arrest warrants in Clayton are governed by O.C.G.A. §17-4-40 through 17-4-47. Law enforcement agencies, including the Clayton Sheriff's office, maintain records of outstanding warrants. Members of the public may request warrant information directly from a local police agency in person or by mail, provided the record is subject to public disclosure. To search, requesters will need to supply identifying information such as a full name or date of birth. Searches for active warrants are generally provided at no charge.

Under O.C.G.A § 17-4-41, a valid arrest warrant must clearly state the name of the person sought; the alleged offense; the date, time, and location of the incident; the victim or affected party; and the county of jurisdiction, which in this case is Clayton.

How to Find Arrest Records for Free in Clayton

Several law enforcement agencies in Clayton have arrest authority, including the Sheriff’s office, the Clayton Police Department, and Clayton University Police. Among these, the Sheriff’s office serves as the primary law enforcement authority and is responsible for operating the county jail. Arrest records maintained by these agencies are available to the public at no cost.

Members of the public may review arrest records in person at the specific agency that made the arrest. In-person inspection is free and typically allows access to records covering a wider date range and, in some cases, more detailed information than online tools. Fees may apply if copies of documents are requested.

The Sheriff's office also offers remote (online) access to an inmate roster, which lists individuals who have been held in the county jail within the past 31 days. Name-based searches through this system can return brief, summary-level arrest information.

Clayton County Arrest Report

Although Clayton arrest reports and arrest records are both official public documents related to arrests, they are not the same and do not contain identical information.

An arrest report documents a specific arrest event. It is prepared by the arresting or reporting officer and provides a narrative account of the incident, including the identity of the arrested individual and the circumstances that justified the arrest. In essence, it describes what occurred during a single arrest.

Arrest records, by contrast, reflect an individual's overall history of interactions with law enforcement. They focus on the subject of the record and summarize arrest-related information associated with that person. This may include one arrest or multiple incidents.

In practical terms, arrest reports capture individual arrest events within the county, while arrest records consolidate arrest information tied to a specific individual.

How to Get an Arrest Record Expunged in Clayton County

Arrest records in Clayton may be restricted from public access if statutory requirements are met. In Georgia, this process is known as record restriction, not expungement. Restricted records are not erased; instead, they are sealed from non-criminal justice use. Subsequently, access is limited to authorized law enforcement and judicial officials.

Record restriction in Clayton County is governed by O.C.G.A. §35-3-37. Eligible cases generally include arrests that did not lead to a conviction, such as dropped charges, dismissed cases, acquittals, and certain qualifying misdemeanor offenses. The required waiting period varies based on the case outcome. Some cases are eligible immediately, while others, particularly specific misdemeanors, require a waiting period of up to four years.

The application for arrest records restriction in Clayton depends on the arrest date.

  • Arrest before July 1, 2013: Applicants must submit a request directly to the arresting law enforcement agency, which then reviews and forwards the request as required.
  • Arrest on or after July 1, 2013: The restriction process is initiated through the prosecuting attorney's office, though supporting documentation must still be gathered.

For arrests before July 1, 2013, applicants are required to provide:

  • A completed Request to Restrict Arrest Record form (available from the arresting agency or the Georgia Bureau of Investigation)
  • A copy of the applicant's criminal history record
  • A certified copy of the final case disposition from the court that handled the case

The arresting agency will then forward the completed application to the prosecuting attorney for review.

In both cases, if the prosecutor approves the request, the appropriate disposition code is entered into the GCIC system. The applicant must then submit the approved application, along with the required processing fee, to the Georgia Crime Information Center.

How Do You Remove Arrest Records From the Internet?

Although access to restricted arrest records may be limited on government-maintained databases, this restriction does not extend to privately operated data aggregation websites. Once a record restriction is completed, official law enforcement and judicial systems are updated accordingly. However, individuals with restricted records may need to take additional steps by contacting third-party data providers directly. In such cases, the individual may be required to submit a copy of the approved record restriction order and any supporting documentation to ensure the information is removed or suppressed from privately managed public databases.

What Do Public Arrest Records Contain?

A publicly accessible Clayton County arrest record generally includes the following information:

  • Arrestee details: Full name, age, sex, physical description
  • Arrest information: Arresting agency, intake date and time, and release date and time (if applicable), docket or case number, listed charges, charge counts, and bond or bail amount
  • Case outcome: Final disposition of the arrest or charges
